Agreement between User and Michelle Whitmore (artist) at michellewhitmore.co.uk
Welcome to Michelle Whitmore Art Gallery.
The michellewhitmore.co.uk website (the "Site") is comprised of various web pages operated by Michelle Whitmore, Artographer. michellewhitmore.co.uk is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of michellewhitmore.co.uk constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
Michelle Whitmore Art Gallery (and michellewhitmore.co.uk) is a service offering Hand-embellished digital Fine Art Prints, Commissioned Fine Art Prints, Reproductions, Other Products & Goods, and all other services.
RIGHTS TO ARTWORK AND IMAGES:
Copying or reproducing artwork created by Michelle Whitmore (as seen on michellewhitmore.co.uk, or elsewhere) is strictly prohibited without written permission from the artist.
Michelle Whitmore retains all rights to all artwork until it has been purchased by a private or public collector at which time the collector receives the right to display the artwork in their home or business.
Michelle Whitmore retains all rights to the image of all artwork including the rights to the image of sold & commissioned original paintings.
Michelle Whitmore retains the right to make REPRODUCTIONS OF ANY AND ALL ARTWORK CREATED BY Michelle Whitmore UNLESS THE COLLECTOR HAS PURCHASED THE FULL OR PARTIAL RIGHTS TO THE ARTWORK in addition to purchasing the original painting.
Collectors have the right to display the artwork in their home or business, but retain no other rights to the artwork.
Any image of the interior which includes the artwork in a 3rd party publication (such as social media, magazine, or book) must come with attribution (artwork title, artists name).
All other uses must be agreed to in advance in writing.

ELECTRONIC COMMUNICATIONS:
Visiting michellewhitmore.co.uk or sending emails to Michelle Whitmore constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
YOUR ACCOUNT:
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Michelle Whitmore is not responsible for third party access to your account that results from theft or misappropriation of your account. Michelle Whitmore and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.
CHILDREN UNDER THIRTEEN:
Michelle Whitmore does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use michellewhitmore.co.uk only with permission of a parent or guardian.
RETURNS POLICY:
We are not liable for any mishandling or failed delivery by the shipping service.
Return policy: All original artwork sales are final. We do not offer returns, refunds or exchanges on original artwork.
Every Michelle Whitmore print is made-to-order. In the rare event that an item arrives damaged or not in perfect condition, I will arrange for a replacement to be sent to you within 30 days. To be eligible for a return, your item must be in the same condition that you received it and in its original packaging. You’ll also need the receipt or proof of purchase. Please email photographs to michelle@michellewhitmore.co.uk within 24 hours of delivery, clearly showing the damage the artwork received in the delivery process.
I offer a 100% satisfaction guarantee on all of our products and if something goes wrong, I will try to make it right.
For prints and products that arrive in perfect condition, I am unable to accept returns, exchanges or change of mind as I do not hold an inventory.
I do not offer refunds.
